La situaciÃ ³n migratoria que se tiene en Estados Unidos afecta a los derechos y obligaciones que se tienen segÃ ºn la ley. Muchas veces es posible cambiar de categorÃ a, mientras que en otros en prÃ ¡cticamente imposible.Ã Ã Ciudadanos americanos La inmensa mayorÃ a de las personas que vivimos en Estados Unidos somos ciudadanos americanos. La ciudadanÃ a se puede obtener de cinco formas distintas. La mayorÃ a son ciudadanos desde el momento de su nacimiento pero tambiÃ ©n se puede adquirir posteriormente.Ã Los ciudadanos tenemos el derecho de vivir y trabajar en Estados Unidos y todos los que nos reconocen las leyes. Pero tambiÃ ©n tenemos obligaciones. Desde el punto de vista migratorio, ser ciudadano tiene importantes ventajas como: imposibilidad de ser deportadosÃ ³lo en casos extremos y concretos se pierde la ciudadanÃ ase pueden pedir los papeles para varias categorÃ as de familiares y en aplicaciÃ ³n de DAPA los ciudadanos podrÃ ¡n extender protecciÃ ³n frente a la deportaciÃ ³n a sus padres y madres. Por Ã ºltimo recordar que la ciudadanÃ a americana se extiende a los territorios de Estados Unidos como, por ejemplo, Puerto Rico (estos son los documentos que se necesitan para viajar a la Isla). Residentes permanentes legales (LPR por sus siglas en inglÃ ©s) Los residentes permanentes legales tienen a su nombre una green card, tambiÃ ©n conocida como tarjeta de residencia. Pueden vivir y trabajar indefinidamente en Estados Unidos, pero no son ciudadanos, por los que sus derechos estÃ ¡n mÃ ¡s limitados y tienen obligaciones que sÃ ³lo aplican a a ellos. Estas son 13 diferencias entre ciudadanos y residentes que hay que tener presentes. Una vez que se tiene una tarjeta de residencia, en casos muy concretos es temporal (inversores y algunos casos de esposos de ciudadanos), convirtiÃ ©ndose mÃ ¡s tarde en definitiva, si todo va bien y se cumplen con todos los requisitos legales. Extranjeros con visa no inmigrante En esta categorÃ a entra un amplio grupo de personas. Cada una debe respetar las condiciones de su visado (o, en su caso del Programa de ExenciÃ ³n de Visas).En lÃ neas generales y para ilustrar las diferencias pueden establecerse las siguientes subcategorÃ as: Visas de doble intenciÃ ³n Son las visas de trabajo H-1B para profesionales y modelos y la L-1 (versiÃ ³n A y B) para ejecutivos, directivos y personal con conocimiento especializado que trabajan para multinacionales.Ã Son visados muy cotizados.Una de sus grandes ventajas es que son consideradas como visas de doble intenciÃ ³n. Esto quiere decir que su titular no tiene que demostrar la intenciÃ ³n de regresar a su paÃ s y que puede buscar activamente quedarse en Estados Unidos como inmigrante y que le patrocinen una green card. Visas especiales Como la K-3/K-4 para esposos/hijos de ciudadanos americanos, que es poco utilizada o la K-1/K-2 para novios/as de ciudadanos y sus hijos, que es mÃ ¡s utilizada. Particularmente la K-1 puede dar problemas si no se siguen sus reglas. Se otorga al novio o prometida de un ciudadano americano para que ingrese a Estados Unidos para casarse y a partir de ahÃ , mediante lo que se llama ajuste de estatus, solicitar la green card. Una vez que se ingresa a EEUU hay que seguir todos los requisitos de la visa. Es decir, no casarse a tiempo, de ninguna de las maneras o casarse con otra persona distinta a la que solicitÃ ³ la visa es un error (grave).Ã Visas no inmigrante Son muchas y muy diversas entre sÃ , con distintas reglas. Pero tienen un elemento en comÃ ºn: se tiene que demostrar la intenciÃ ³n de no quedarse en Estados Unidos y de tener lazos econÃ ³micos y/o familiares fuertes en el paÃ s de residencia habitual.Ã En esta categorÃ a entran visas como las de trabajo, las de estudiante o la de turista e incluso las de inversiÃ ³n como la E-1 para casos de negocios de importaciÃ ³n/exportaciÃ ³n o la E-2 donde hay una inversiÃ ³n sustancial de dinero.Ã En cuanto a los turistas, pueden ingresar a Estados Unidos con visa B2, en el caso de mexicanos en la frontera con la lÃ ¡ser y chilenosÃ y espaÃ ±oles sin visado (si llegan por aviÃ ³n necesitan una ESTA). Ã Todos los turistas deberÃ an tener en cuentaÃ conÃ cuÃ ¡nta frecuencia se puede ingresar a EEUU como turistaÃ y quÃ © pasa si una persona se queda en Estados Unidos mÃ ¡s tiempo del permitido. Es cierto que en circunstancias especiales es posible cambiar una visa no inmigrante porÃ otra visa o incluso una residencia. Pero no siempre. Hay que tener siempre presente las circunstancias y requisitos de la visa que se tiene (o no visa, en su caso) y cÃ ³mo se quiere hacer el cambio y si es posible y cÃ ³mo. Para evitar problemas siempre es aconsejable consultar con un abogado de inmigraciÃ ³n e informarse sobre quÃ © tipo de visa se tiene. Situaciones especiales Algunas personas presentes en Estados Unidos tienen una situaciÃ ³n especial debido a sus circunstancias personales, como por ejemplo: AsiloVisa U para vÃ ctimas de violenciaVAWAVisa T para vÃ ctimas de trata de personas En general, esas personas con el paso del tiempo y si se cumplen los requisitos acabarÃ ¡n obteniendo una tarjeta de residencia (green card).Especial menciÃ ³n merece el caso de los cubanosÃ que alÃ aÃ ±o y un dÃ a de ingresar legalmente pueden pedir la residencia permanente (green card) porÃ ley de ajuste cubano. Lo que ocurre es que esto Ã ºltimo suele suceder antes de que se resuelva el caso de asilo y asÃ la residencia por ajuste cubano cancela al proceso de asilo. Indocumentados Se calcula que en Estados Unidos pueden vivir como indocumentados mÃ ¡s de 11 millones de personas. Los indocumentados pueden ser deportados, carecen de acceso a beneficios sociales excepto los mÃ ¡s bÃ ¡sicos como WIC, en la mayorÃ a de los estados no pueden obtener la licencia de manejar (aunque hay importantes excepciones), etc. Pero no todos los indocumentados son iguales desde el punto de la ley. En la actualidad los jÃ ³venes que llegaron a Estados Unidos siendo niÃ ±os pueden acogerse a DACA que les protege frente a la deportaciÃ ³n y les permite obtener un permiso de trabajo por dos aÃ ±os. Para el resto de los indocumentados que no pueden beneficiarse de DACA las posibilidades de legalizaciÃ ³n son escasas, siendo estos 15 posibles caminos. A tener en cuenta Ciudadanos, residentes permanentes e indocumentados que son jÃ ³venes y varones tienen todos una misma obligaciÃ ³n: cumplir con el Servicio Selectivo. Y donde hay migrantes, desgraciadamente hay personas que intentan tomar ventaja de su situaciÃ ³n y prometen beneficios migratorios que no son posibles a cambio de dinero. The Picture of Dorian Gray By Oscar Wilde The Picture of Dorian Gray is a novel written by Irish writer, Oscar Wilde. She realized that all the time she was living in a lie and decided to play poorly on her last show. Dorian became dissapointed and also embarassed in front of Basil and Henry. Her only knowledge of love was love of theatre. Unfortunately, Dorian decided to break up with her. His decision broke her heart and she commited suicide. As the time went on, Dorian still stayed a young man and did not change. The saddest moment of the story is when he killed Basil. His conscience started to chase him, and he grabbed the same knife to kill him and destroy his painting. At the end of the story, Dorian killed himself. The servants hardly recognized him. Ethical Dilemma: But with the development the eating style of the people has been changed. People are concerned about their health. They are noticing the nutrition value, fats and calories in the food. The concerned is increased due to the obesity coming in the people and also the health issues that are occurring in the smaller age. Therefore the first dilemma faced by KFC recently is the unhealthy food having no nutrition value supplied by the company. Therefore KFC has to take some major steps to increase the food value in the chicken. Also, due to frying the chicken, the fats are introduced in the chicken due to the trans frying oils. This also creates the problem of increase in fat in the body and leads to diabetes and heart disease. Ethical dilemmas faced by KFC KFC is one of the most famous fast food chain and many people love the food offered by the restaurant. But, it is observed that KFC is serving the food that is not fitting in terms of the ethical standards. It is using the oil, which have fatty acids in it. This type of oil increases the fats and cholesterol in the body and results in diabetes and risk of heart diseases. Therefore, it is recommended by the science group and Public health authorities of Australia to use a healthier oil for cooking as compared to the earlier one. Due to the use of such unhealthy oil, KFC faced the negative effects that are media reporters and in various countries people boycott the KFC. The company should follow the ethical standards to prevent the health problems due to lack of nutrition in it. KFC has lack of future plan because negative publicity will take away their market share to others. The two employees of the KFC restaurant chains have faced racism and they filed the case against the company. The third dilemma which the company is facing is due to the advertisements of KFC. Due to the attractive ads, the children get attracted by the product which is leading to the obesity in children. The Australian government is banning such advertisements near the schools and in the channels which kids used to see. Also, the fast food has less nutrition content which is making the kids unhealthier (Stowe, 2015). Analysis of Ethical concerns of KFC Even the KFC is struggling to improve its brand image in the eyes of customers, some ethical issues prove the shortcomings in the brand. The issue is related to using unhealthier oil during frying the chicken and also the advertisements that attracts children towards the fast food. Both of these issues have damaged the company reputation. The company agreed with the issues and said to use a better oil in frying the chicken. The issue was reported on 2015 May, that the company is using unhealthy Trans fatty oils for cooking the chicken. This will cause health problems like diabetes and heart risks. KFC also faced boycotts due the same reasons in various countries (Jones, 2005). Also, it has been reported that, due to the attractive advertisements of the brands running nearby the schools and in tv channels causes the attraction of the kids towards the fast food which is not good for kids health. Therefore, the KFC has faced ethical issues related to the same and were told to remove the advertisements from the school campuses. The two employees named Karen and Marin Galvia filed the case against the harassment at workplace. The company was sued for the unfair treatments towards these employees. The case was settled in 2015 and the company paid amount to both the workers. They were paid less as compared to the local workers and faced the racism in this way (Kien, 2011). Also, the coworkers made gender based comments to these workers. Therefore theses two were facing discrimination in terms of pay, comments were made on them due to their gender and race. This spoiled the reputation of the company and both the employees were paid amounts for the settlement. Decision making and leadership in KFC The KFC uses the democratic style of system in which all the team members have the opportunity to express its views. All the team members are included when the decision is made. A decision represents an action chosen from alternatives. Therefore, opinions of members are considered while making any decision. This leads to the combine decision and one employee cannot be blamed over a wrong decision. During the decision making the problem is analyzed. The manager defines the problem to the members and factors are discussed that are obstacles in the solution to the problem. Therefore, in reference to the problem faced by KFC, the oil should be replaced with the better nutritious oil. The second step is to identify the decision making criteria. The decision is made according to the factors that are responsible for the solution of the problem. The main factor here is the cost and the time. The time taken to change all the oil in the company and the cost of the oil that is in the company and the new oil that is bought by the company. After this, alternatives should be thought of as if the oil, which is replaced will suit the tastes or not. Different oils should be tested against it so that if the oil does not go with the taste the other oil should be taken which enhances the taste. Therefore, alternative ways should be incorporated so that a solution to the problem can be determined. Marketing should be done so that to regain the reputation which was spoiled due to the oil usage. The leader is never sure of the outcome of the solution to the problem (Tea, 2010). Therefore, alternatives should be thought of so that it could be laid off in case of not working of the earlier plan. The alternatives are: Risk involvement during the solution to the problem Proper timing of the decision Final selection of the decision. The last stage of the decision making plan is the evaluation. Evaluating the solution to the problem help in finding the real outcome of the solution. The second problem faced by KFC is the racism comments on the employees. The decision making in this aspect is firstly by evaluating the problem by the leaders. After analyzing the problem the solution to this problem is found. The person hit with this problem are compensated by the company after analyzing the problem (Moreno, 2011). The employees were given a training session before they left the company as the compensation. A leaders ethical behavior is a critical issue. The ethical dilemma in KFC occurred in the large scale. This dilemma is related with people understanding and laws. These dilemmas include negative actions. The best way to deal with such issues is to maintain the personal moral. The leaders have to take specific action and to improve the conditions which went wrong during the course of action. Leaders have to set the bar higher and should be ready for the changes in case if required during the course of the solution. Leaders should maintain the standards of ethical conduct. Therefore, the leader of KFC, followed the similar principles by accepting the problem and found the solution related to the problem.
